The Jugendamt is the German federal agency for children: its decisions are in fact binding and at home it enjoys the reputation as a bulwark of social protection. A protection based on a pillar: every child is a patrimony of the community and of the State, which invests in him, and his well-being is linked to a German education, a priority for everything. So in case of separation of a mixed couple, the Jugendamt has clear ideas: the children stay in Germany, with the German mother or father. The other parent will be content with limited attendance, sometimes with the obligation to communicate with the child only in German. This even in the event that the German parent has abandoned the marital ceiling, or is responsible for domestic violence, alcoholism, indifference towards children. The criterion of nationality takes precedence over any other consideration, with a latent threat even for mixed couples who do not separate but who are induced to follow the dictates of the Jugendamt. A separate burden is left to the separated and non-German parent: to contribute to food and to the education of the child, even if he has lost every role in the choices of growth.

Those who do not accept these rules are further penalized, seeing themselves denied even a short holiday with their children; and anyone who escapes due to impossibility or protest to the payment of food, or keeps his son away from Germany, becomes the victim of a European arrest warrant issued by the German court, which is strictly applied by the other European countries. In fact, Germany has created a perfect mechanism, taking advantage of a part of the automatisms of the European judicial area, and of the lack of European norms in family law - which jealously remains sovereignty of the nation states, at a cost of "non- Europe "very high in terms of lack of human rights.

There is one exception: for disabled children, foster care is normally the non-German parent. The Germanic state prefers to dispose of these "weak subjects" and more expensive to assist. Sorry to say, but it is inevitable to think so: it worked like this, in Germany, even some time ago. This and more is revealed with parents who are discriminated against by the Jugendamt. One, French, I met him at Christmas in San Vittore, in a cell at the request of the German authorities. Many do not hold back a heart-rending pain: they have not seen their children for months or years, they have spent their possessions in endless court proceedings strictly in German only, they are abandoned by their own countries which fall in the troops in the face of German "sovereign" decisions.

One of the bravest of these parents, Marinella Colombo, wrote an eloquent book - "I will not leave you alone" (Rizzoli) - which is not just a terrifying account of how a mother actually lost her children (the last interview with them it was allowed at the end of 2010), but it is also an indictment against the shortcomings of today's Europe, where things can still happen. But the majority prefer to keep quiet, in order not to suffer German retaliation.

The European Parliament has received numerous petitions, but the pressure and the total unwillingness to cooperate on the German side have prevented any progress. The European Commission itself is reluctant to intervene, despite questions, letters, meetings with the Commissioner Reding's cabinet (on www.niccolorinaldi.it there is an account of the many initiatives of these years), for lack of competence in family law and respect formal rules of the EU by Berlin. However, discrimination is obvious, and if the Jugendamt were from a smaller country, there would be no such compliments.

The Jugendamt reveals a sense of German insecurity to become properly Europeans, to accept that a child grows up even with a non-German parent, and demonstrates the persistence of a sense of superiority and a role of the State of which these parents are only the last victims, among the innumerable affected
